i'll go against max and say it isnt totalled. the frame horns are still straight, thats the determining factor from that crash. everything thing else is cosmetic. sorry to hear about it. hope you are ok, a car can always be replaced, a life cant, so just be happy you still have your life. i see accidents down here in florida where people dont get lucky. when they crash here, they crash BIG.

I was turning left into the housing sub division where I live after playing golf last monday the 27th.Heavy mid afternoon traffic,two lane street,this guy comes around everyone on the left in a no passing zone,in a firestation zone going 60 to 65 mph.I go to make my turn,he strikes me in the drivers side fender,tears the nose off the car,carreens down the street,catches up with a 3/4 ton dodge ram that was going away from us at 40 mph,hits it in the rear,the truck spins out of control,hits a light pole in front of the fire station,these poor people spill out on the ground and have to be taken away on stretchers.The VW GTI finally stops on the front lawn of the fire station,this guy gets out,he looks like the Geico caveman in dirty clothes and sandals,long hair,beard,the whole deal!
Out of state plates,turns out it wasnt even his car,he borrowed it.Anyway I was in shock so I went ahead and made my turn,fished a five iron out of my golf bag and walked across the street,by then the firemen were pouring out of the station,they relieved me of my golf club so that was that.Yes there is insurance on the GTI,yes I did sustain some injuries due to the severity of the impact,yes I did retain Bill Hurst as my attorney.
Note also,the police told me I may have to wait up to a month for an accident report so I called someone I know in the mayors office and got it in three days,dont get hit in Indy,all they give you is a business card.The guy that hit me,he said he was late for an exam at the local university
and was trying to pass seven cars at once.Im very angry,Im going to sue somebody!!
 
Well,the other teams insurance people called today,they say the car is a total.They also say that they will let me off the hook for the princely sum of 2,500 as the settlement.I suggested to them that they were a little light in their loafers.They suggested I accept the offer as they felt that the car could be replaced for that much.I think we have had our last conversation.I would also like to add that I dont curse,make remarks or try to agitate these folks.I treat them as nicely as I can and always tell them to have a nice day,please and thank you.Where am I failing?
 
I've been involved in a couple of beauties that weren't my fault either and what I did was file under my collision so that my insurance company would need to go chase everyone down ( lawyers meeting lawyers). I found that my results were better for me as I did not have to put up with the BS, and I got what I wanted. I don't know if this would be possible in your case, just wanted to share. Glad to see adleast you were not hurt further.

My experience is to remain calm and polite but firm in your position. Keep demanding to speak to someone higher. Each liason is only allotted to deal outside the box so far. Eventually, you'll get to the level that has the flexibility to meet your terms. The downside is this is a time consuming task and that is in their favor and they know it. They hope for you to tire and cave in to their latest offer.

Jamie... the car may not be "totaled" for someone who can get used parts from other cars and slap em on cheap. But for all insurance reasons it is because they go by dealer list prices.

A scuffed bumper a broken grill and two broken headlights will total a 1993 gen 1.
 
First off, figure out what you want out of all this.

Then work with them.

Then when they say "No", say, OK, well I guess you'll need to talk to my lawyer.

That worked for me in an accident in which I was rear ended. They totally lowballed me at first. Then I believe I got a repair quote from a good shop, added in the cost of my missing work, the cost of having my husband (then boyfriend) take a day off work to take care of me and my son, some extra for the hassles of going to docs etc. IIRC, I kept it reasonable, with a little cushion, and mentioned I wasn't sure how much doctor's visits were going to ultimately total..... and once I mentioned lawyer, I pretty much got what I wanted.

FYI, I was looking for a quick settlement and did feel that the woman who rear ended me was truly sorry and it was just a bad intersection, etc.

Tell them to show you a Mark VIII in the same condtion that can be replaced for that much and you will take it.

That's more logical than it may sound.

While most insurance claims are settled on 'book value', the uniqueness can be a viable argument.
 
I will try the escalation to a higher level plan.My car dealer friend also mentioned this stratagy.Im trying to appeal to their logic but unfortunatly
my shoulder is making a popping,snapping noise and sometimes it really hurts so Im gonna make the trip to the lawyers office anyway.

Sorry to hear about your bad luck.

What are your plans with the car? If you can get a good settlement from the insurance company, you might be able to buy the car back from them cheaply, and have more than enough left over to repair the car.
 
Wow sorry that happend to you,
My 93 was totaled I got $3,300 out of the ins company.
Stick to your guns don't let them low ball you and keep your cool.
Take the car to me most expensive body shop in your area get a quote to get it fixed use that high dollar amount to get more money out of them.
It worked for me.
