I nailed her. Straight on and she had two kids in the car.

I hate to burden all of you including myself for writting this dribble out but I'm having a bad day. After getting off of work at 2:00am yesterday morning I went directly home and got 3 hours of sleep before school at 8:00am. I sat through class on my caffiene high as usual and crashed right afterwards. It all went just like clockwork. I get home and am on my way to the Houston Zoo to see a friend.

Driving down my street I debate wheather to go to the bank or Autozone first where I want to pick up one of those visor cd-carrier things. (They are 10 dollers cheaper than Best Buy) I make a left heading toward the Autozone first because Its more out of my way. I get there and they will not take my credit card because its not in my name so I head off dissapointed. I jump back in my car and go toward the bank. I go through a light and come upon the next light which was green. I was 50 yards away when It turned green so I was cruzing at the speed limit when I got to the light.

There was a 18 wheeler which had just cleared the intersection when I came up to the intersection. What I didnt see because my view was blocked by other cars was another car behind the 18 wheeler still in the middle of the intersection. She had apparently run the light (witnesses on both sides of the street say she did) and tried to follow the 18 wheeler throught the intersection.

So anyway, Im coming along at 35 miles an hour into the intersection when lo and behold a car appears stopped directly in front of me. I had no where to go so I slammed on the brakes. As I was slidding toward her I was thinking, "This is actually happening TO ME". What a egotistical thought to have right? But I digress,. I slide the 20 feet directly into the side of her car. There were 2 kids in the backseat WITHOUT THEIR SEATBELTS ON. A 2 year old and a 5 year old. The two year old WAS in his carseat at least so that's good, but he did manage to get a cut behind his right ear. May have needed a stitch or two but I highly doubt it.

So the cops came and an ambulance and they wrote out a report giving her a ticket for running a red light along with not having insurance and not having seatbelts on her kids. They all went to the hospital as she might have had whiplash although how you get whiplash when hit from the side is beyond me (maybe someone could explain this). She seemed fine though so I wasnt worried. I got a ticket for no inspection ticket and no insurance. I am getting insurance on my car tomorrow. I tried today but couldnt do it in time. Im an idiot for not having insurance. I was waiting for the title to come in the mail so I could sign it over to my mother to put in her name. I got the title 2 days ago. I guess sitting around with my thumb up my ass entertains me too much for me to get out and do the important stuff.

There was no damage done to my car. A scratch on the bumper and that's it which isnt much when you think about how hard I hit her. On the other hand her car had to be towed away with both passenger doors crumpled in. The car I hit was a early 90's corrolla and while I did damage the car it still kept the kids inside which is a relief. The back passenger window was blown out completely. This is right where the 2 year olds car seat was. I hope to God that he didnt hit that window with his head. It didnt look like he did and he looked fine when I took a look at him. He was alert and followed my eyes with his eyes so I highly doubt he hit the window.
The lady was a perfect product of industry. From moments after the wreck untill she stepped into the ambulance 25 minutes later she was on her cell phone. For the first minute she was talking and I never saw or heard her talk again. She spoke only spanish I think. She understood when I asked if she wanted me to call an ambulance but wouldnt get off to call one so I had to find someone in traffic to find a cell phone to call for an ambulance.

An hour later I was on my way with a couple scratches on my bumber and that's it. I was lucky. Very lucky. My car is otherwise completely unharmed and I'm getting insurance on monday.

Sorry to hear about the accident, its always a nervewrecker with kids involved, even if its not your fault.

Same thing happened to me. It's the nature of the beast here in Texas -- lots of drivers and not the same number of insurance policies.

The accident could have been your fault. You only have the right to enter the intersection on green after it is clear of all traffic. If you entered the intersection before the truck or the trailing car was clear, it was your fault, regardless of what color light was facing you. Your explanation is vague on this issue. You said,

I'm not trying to make you feel guilty, I am just pointing out the fact that you seem to take no liability for the accident. You should always assume that someone is on the other side of the obstruction (the truck, in this case), and adjust your approach accordingly. Also, I don't care what you have on your mind when you're driving if you hit one of my family or friends- your mind should be on driving.

I hope that no one was serioulsly injured, and I'm glad that your car suffered no more damage than it did. This is a remarkable testament to the safety of the Lincoln vs a smaller car.

Pray for the family that was injured, get some insurance, get some sleep, and take driving seriously. Your temporary frustration is not worth anyone's life.

I dont know how I gave you the impression my mind was on anything else than driving but Ill say it clearly now. My mind was on nothing else but driving. I was not mad/sad/tired or otherwise just driving along listening to my music.

Dr. Dave, the 18 wheeler had cleared the intersection when I came up to the intersection and this car was blocking other lanes and came into my lane and into my vision just moments before I hit her.(remember I was going the speed limit and coming up on the intersection quickly but I'm sure the 18 wheeler had cleared the Intersection) She was also in the intersection illegally from what I am told. The cop told me there was a witness who saw her run the red light in her left turn onto hilcroft (adjacent street). I'm also not sure if the same "law" applies in texas as it does in florida.

As far as the damage is concerned. I'm not sure what I'm going to do. I sold my old bike today and got some extra cash in my pocket but I'm more concerned about a small oil leak I seem to have developed than anything else. I knew the oil pan was leaking very very slowly before but the jolt from the wreck may have helped that problem along in its lifespan. I need to wash the car and see how bad the scratches are on the bumper but so far they do not look so bad and the bumper is not moved back at all. I am hearing a popping sound from the right side suspension now though so I'm sure what's going on.

As far as the ticket goes because I wasnt at fault in the accident I'm hoping that If I get insurance before the court date (or within 10 days of the ticket) that I could get the ticket dismissed. I'll have to ask around about that though to see what the law is.

I'm not going to try to defend myself for not having insurance and driving around. I couldnt get my title before because the seller of my car messed the date up on the title and I had to track him down OUTSIDE OF THE HOSPITAL because he has colon cancer and is fighting for his life. I just got the title in the mail the other day (got the title 3 weeks ago) and now that I have the title I'm transfering it to my mothers name just as my sister has done. This will make my insurance 20% of what it would be with the cheapest policy that I have found yet other then Amica. So yea, I've been stupid and havent gotten around to getting my *** up after school and taking my mom to the dps.

umm.. I think that's about it.

I can tell you with absolute certainty what the laws are in Texas. A green light means you "may go" not that you have to. And the may go, is applicable to when the intersection is clear. Insurance bought today won't eliminate the liability for a citation written yesterday. You were still driving without insurance.

You may have another problem. Check this out. Even though the car is going to be in your mothers name, and on her policy, she's still going to have to identify you as the driver. The question about accident history will be asked. If you tell the truth, the way the insurance industry is right now they may choose not to cover you at all. If they do its going to cost. If you choose to lie; they'll probably catch you at it, because they have people that do nothing but match their insureds and applicants against police reports, which are a matter of public record. Lets say you lie and they write the policy; later on you have an accident for which they have to pay benefits for. Here again there are employees who do nothing but look for reasons to deny payment. If they catch you then you're guilty of felony insurance fraud.

Depending on your age, your student status (full time vs part-time) and employment status you may not be legally eligible to be on your mothers policy. If not would you really want to expose her to that liability? Again, if you lie to obtain coverage, it's fraud and you're making her an accomplice.

I'm not telling you all this to rain on your parade, but to just mention some possibilities that you need to be aware of. Hope things work out for you. Also don't be surprised if the woman you hit doesn't try to sue you, you know how law suit happy they are in this state.

I've already gotten a quote from the insurance company a month ago and talked to them again on the day of the wreck (talked to the same person so she knows what's going on). They ask if you have any "outstanding tickets" and if you have been in any accidents.

She DID get the ticket didnt she? I have her information if I need it and same with her. If she decides to sue me she can and I should be getting word any day now. I know if I do go to an insurance company and they ask if I've gotten in a wreck I should tell them the truth and I know because it's not my fault they will give me a form to fill out so they will cover me on that wreck AND they should not pump my insurance up because of it unless they want to start blowing wind up my ***. (that's a huge sentence)

THE PERSON WHO I HIT GOT THE TICKET AND THERE WERE WITNESSES ON BOTH SIDES OF THE STREET WHO SAW THE ACCIDENT AND "CLAIMED" THEY SAW HER RUN THE RED LIGHT. Even her "witneses" say she ran the light. The trailer was already out of the intersection before I got there and I did not see her untill I came to the beggining of the intersection. (I swear most of your reading skills are in serious trouble because this is the 3rd time I'm writting this.)

My question is why I would have to tell the insurance company about the accident if she doesnt have insurance and doesnt sue me considering the fact that she got the ticket. In this situation is the accident a "public" matter or "private". Why would it be fraud?


As far as what I'm going to do. Well Im going to go out to my car right after I'm done typing this and move my car and see if there's an oil stain under the car like I suspect. I'll start from there. The car has been driven 30 miles since the accident with no significant differences since before the wreck. The clunking sound has been happening since I put on the upper control arm and endlink. The oil drip has been there since I had the oil changed the first time I had it changed when I got my car. I think its the oil pan and not a large problem, but as you all know if there's a quart of oil coming out of that thing a night I will have to fist over 1000 bucks to get that fixed.

edit: Moved the Mark and No oil. The oil must have been from my sisters volve which does leak oil. Ohh and I have discovered why it would be fraud. Its because the police write up a report on the accident, but that should not make your insurance more expensive esp. if the damage done to your car is under the deductable.

Glad you discovered where the oil was coming from. I also hope things go smoothly for you. People sue for the hell of it, not because it's right. If they think you, or your family, has something they want to get it from you. I don't know where it's at in Houston, but in San Antonio, just inside the front door of the PD Headqurters on the left, is a room for insurance company and Personal Injury attorney's employees to sit and go over accident reports. Every PD has one because they're required to make the reports available for public review. Anyone who is injured can expect solicitation letters from attorneys wanting to represent them. Just think of all those commercials you see on daytime TV.

I only wanted to help you by mentioning things you may not have thought about. I certainly bear you no ill will. :)

HEY We dont have to tolorate this kind of insult. All everyone is saying is regardless of who is at fault in the accident YOU SHOULD HAVE HAD INSURANCE! YOU are wrong for not having insurance, no matter what anyone else did or didnt do.

What would have happened if it was your fault and those kids were permanantly injured? Who would pay the dr's bills? Thats the point of having insurance.

So, lets make this simple. Im glad your car wasnt seriously damaged, I hope her children are okay, Im gld you werent hurt. Now that all that is said and done GO GET INSURANCE !!!!!!!!!

IF, I read right, the lady wouldnt get off of her phone to call an ambulane???? Her kids are in the back, no seatbelts, one was bleeding and she didnt call the ambulance. Thats seriously messed up! IF I read it right?

Anyways, one tip, dress nice for the judge!! Wear long tie, nice shirt and nice pants. Not shorts and a t-shirt. It workS!

Anyways, it's a not at fault accident. Don't sweat it too much. You'll get in a little trouble for no insurance, but it won't be too bad. Bottom line is, you're young, driving anything approaching a decent automobile is going to cost a load of insurance money. All i can say is shop around, and make sure you're covered. If she sues you (which still may happen, depending on the law in your state... no fault in michigan allows the drunk to sue the innocent victim) you can get royally screwed without insurance. But if you've got nothing to lose they'll probably realize they have nothing to sue for, and all will be well.

But get insurance NOW. People like you driving around without insurance is one of the reasons it costs those of us who obey the rules more money.

No insurance? What a surprise. We have those 'buy your insurance by the month' places on every other corner that convienence stores do not occupy down here in South Texas.

If I had a dime for every uninsured motorist that exists down here, my bank accounts would be right up there with Bill Gates!

This is one topic I do not wish to vent on. Been there, done that!

Well I think were all in complience with the fact I was an idiot for not having insurance. I'll have it by tomarrow so don't let it bother you too much.

About the insurance places "on every corner". I didnt even know about them untill the insurance lady told me about them. I must be blind ehh?

I washed the mark today and you can barely see the scratches (plus if you take a look at the picture its obvious the bumper needs painting anyways).

On a side note. Its amazing how much more aware you become of potential accidents and driving in general after you are in an accident. This was my first accident and its a "changing experience". The awareness of bodily injury through potential accidents is astounding and the repercusions which before you were so aware of are now gone. Reason being that by driving defensively your time spent worrying (*for lack of a better word) is taken up by driving defensively. You might have to leave a little earlier to get places but you enjoy the ride much more. (esp. if you have a great soundsystem and a washed car)

Anyway, I'd like to thank everyone for their input and express my appreciation for your candid suggestions.
